Florida Amendment 3 (2026): What It Means for Buyers

Florida voters passed Amendment 3 in 2026. What changes for homestead exemptions, non-homestead caps and new residents, and when it takes effect.

By the Swipe Home team · Published

Short answer: Amendment 3, approved by Florida voters on November 3, 2026 with about 62% of the vote (unofficial, above the 60% needed), raises the homestead exemption from non-school property taxes to $150,000 in 2027 and $250,000 in 2028, with inflation adjustments after that. It also lowers the annual cap on assessment increases for non-homestead property from 10% to 5%. School taxes are not affected. The changes take effect January 1, 2027 and first show up on tax bills in November 2027.

What changes for homeowners

  • Homestead exemption from non-school taxes: $150,000 in 2027, $250,000 in 2028, then adjusted for inflation.
  • School district taxes: unchanged. The existing exemption rules still apply to school levies.
  • Non-homestead property (second homes, rentals, commercial and vacant land): the yearly cap on assessed value increases drops from 10% to 5% for non-school taxes. This limits growth in assessed value, not the total bill.

If you are moving to Florida

Reporting on the amendment says the larger exemption applies to owners who are permanent Florida residents as of December 31, 2026. People who become residents later start with the current homestead exemption when they first qualify and become eligible for the increased amount in their fifth year of receiving a homestead exemption. If you are relocating, confirm how this applies to you with your county property appraiser.

What it means when you buy

  • A seller's current tax bill can be a poor guide to yours. Florida reassesses a home at market value after a sale, and your exemption depends on your own residency and filing.
  • File for homestead with your county property appraiser by March 1 of the year after you buy and move in. Without the filing, you get no exemption.
  • If you are buying a second home or a rental, the lower 5% cap on assessment increases applies to non-school taxes.
  • Local governments may adjust millage rates or budgets in response, so tax bills can still change year to year.

Results reported here are unofficial until certified, and the implementing details will come through the Legislature and county property appraisers. We will update this guide as official guidance is published.
